1. Introduction

FusionTech Industries LLC (“we,” “us,” or “our”) operates the Kurb platform at kurbsale.com — an online marketplace that allows individual sellers (“Sellers”) to host garage and estate sales and buyers (“Buyers”) to browse and submit purchase offers. This Privacy Policy explains how we collect, use, share, and retain personal information in connection with the Kurb platform. Please read this policy carefully. By using the platform you acknowledge that you have read and understood it.

3. Platform Overview and Roles

Kurb is a multi-tenant SaaS platform. FusionTech Industries LLC acts as the platform operator and a data controller. When Buyers interact with a Seller’s Storefront, both FusionTech and the Seller determine the purposes and means of processing Buyer personal information. Accordingly, FusionTech and each Seller are joint data controllers of Buyer Data under GDPR Article 26. The joint controller arrangement — including each party’s respective responsibilities and the primary point of contact for data subject rights — is set out in Section 7 of the Seller Terms of Service, available at kurbsale.com/terms. A summary for data subjects is available on request. Buyers are visitors who browse and submit offers without needing an account.

4. Information We Collect

4.1 Information About Buyers

Buyers can browse the platform without providing any personal information. We collect the following information about Buyers:

Buyer contact information (name, email, phone) is stored in the Seller’s database record, tied to the specific offer or subscription. It is not stored in a central Buyer profile. The same session identifier is reused when a Buyer visits multiple Sellers’ storefronts on the platform (cross-Seller session persistence). If a Buyer consents to Personalization storage, their name, email, and phone are also saved in their browser for form pre-fill convenience. Server-side offer data is stored regardless of this browser consent.

4.2 Information About Sellers

When a Seller creates an account, we collect:

  • Email address and identity metadata (via Clerk, our authentication provider)
  • Sale name, branding preferences (colors, title, grid layout)
  • Stripe customer ID and subscription billing details
  • Optional: custom email sender address (used as reply-to on Buyer emails)
  • Referral source (which Seller referred them to the platform)

4.3 Information We Do Not Collect

  • Payment card data (handled entirely by Stripe; we receive only a Stripe customer ID)
  • Government-issued ID or financial account numbers
  • Precise geolocation data
  • Behavioral tracking data, advertising pixels, or marketing analytics

5. How We Use Your Information

5.1 Buyer Data

We use Buyer information for the following purposes:

  • Offer fulfillment — to allow Sellers to review offers and contact winning Buyers
  • Outbid alerts — to send Buyers an email notification when a higher offer is submitted (only if the Buyer opted in)
  • Session recovery — to allow Buyers to request a magic link to restore their session and view their offers
  • Subscriber updates — to allow Sellers to email their subscriber list when new items are added
  • Inquiry forwarding — to forward a Buyer’s question and contact information to the relevant Seller

5.2 Seller Data

We use Seller information for the following purposes:

  • Account authentication and management
  • Processing subscription payments
  • Providing and improving platform features
  • Sending transactional communications related to your account

5.3 Legal Bases (GDPR/UK GDPR)

For individuals in the European Economic Area (EEA) or United Kingdom, our legal bases for processing personal information are:

6. How We Share Your Information

We do not sell personal information to third parties. We do not share data with advertising networks. We share personal information only with the following service providers, strictly for the purposes described:

Each service provider is subject to contractual data protection obligations. Their privacy practices are governed by their own privacy policies.

6.1 Sellers as Data Recipients

When a Buyer submits an offer or subscribes to a Seller’s sale, the Buyer’s name, email address, phone number, offer amount, and any message content are made available to that Seller through the platform dashboard. Sellers may also write and store private notes about Buyers. As joint data controllers, Sellers are independently responsible for handling Buyer personal information in compliance with applicable data protection law. Seller obligations — including permitted uses of Buyer Data, data security requirements, and cooperation with data subject requests — are set out in Section 7 of the Seller Terms of Service.

7. Browser Storage and Tracking Technologies

Kurb uses browser localStorage — not cookies — for all client-side data storage. No tracking pixels, advertising cookies, or third-party analytics are deployed.

A consent banner is displayed on first visit. Consent preferences are stored in the browser and can be updated at any time. Note: Because the session identifier is stored in localStorage (not a cookie), standard browser cookie opt-out mechanisms do not apply to it. The session identifier is strictly necessary for the platform to function.

8. Data Storage and Security

All platform data is stored on infrastructure operated by Cloudflare, Inc., located in the United States:

  • Seller and Buyer offer/subscriber data: Cloudflare D1 (managed SQLite database, US region)
  • Item images: Cloudflare R2 object storage (publicly accessible by URL when published)
  • Email delivery logs: retained by Resend per their own retention policies
  • Seller authentication data: retained by Clerk per their own retention policies

We implement appropriate technical and organizational security measures to protect personal information against unauthorized access, loss, or disclosure.

9. Data Retention

We retain personal information for the following periods:

10. Your Privacy Rights

10.1 All Users

You may contact us at any time to ask questions about this policy or our data practices. Sellers may request account deletion directly through the "Delete Account" button within the dashboard. Buyers may request access or deletion by contacting privacy@kurbsale.com.

10.2 EEA and UK Residents (GDPR / UK GDPR)

If you are located in the European Economic Area or the United Kingdom, you have the following rights under the GDPR or UK GDPR:

  • Right of access — to obtain a copy of your personal information
  • Right to rectification — to correct inaccurate data
  • Right to erasure (“right to be forgotten”)
  • Right to restriction of processing
  • Right to data portability
  • Right to object to processing based on legitimate interests
  • Right to withdraw consent at any time (where processing is based on consent)
  • Right to lodge a complaint with your supervisory authority

10.3 California Residents (CCPA / CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) as amended by the CPRA:

  • Right to know — to know what personal information we collect, use, share, or sell
  • Right to delete — to request deletion of your personal information
  • Right to correct — to request correction of inaccurate personal information
  • Right to opt out of sale or sharing — we do not sell or share personal information for advertising
  • Right to limit use of sensitive personal information — we do not use sensitive personal information beyond what is necessary
  • Right to non-discrimination — we will not discriminate against you for exercising your rights

To submit a CCPA/CPRA request, please contact us at privacy@kurbsale.com. We will verify your identity by requiring the request to be sent from the email address associated with your data and will respond to verifiable requests within 45 days.

11. Children’s Privacy

The Kurb platform is strictly restricted to users 13 years of age or older as outlined in our Terms of Service. It is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us immediately at privacy@kurbsale.com and we will take steps to delete the information.

12. International Users and Data Transfers

FusionTech Industries LLC is based in the United States. The Kurb platform is operated from the United States and all infrastructure is hosted by Cloudflare in the US. Sellers and Buyers may be located anywhere in the world. If you are located outside the United States, your personal information will be transferred to and processed in the United States. By using the platform, you acknowledge this transfer.

13. Seller Responsibilities

When you use the Kurb platform as a Seller, you receive personal information about your Buyers (name, email, phone, offer details, subscriber information). You are responsible for:

  • Handling Buyer personal information in accordance with applicable privacy laws
  • Not using Buyer data for any purpose other than fulfilling offers and communicating about your sale
  • Not sharing Buyer data with third parties without authorization
  • Responding to any Buyer requests about their personal information that you control

Seller notes about Buyers are stored during the active retention period. Sellers are responsible for ensuring that note content is appropriate and compliant with applicable law. These obligations are strictly detailed in the Data Processing Agreement incorporated directly into the Seller Terms of Service.

14. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify Sellers of material changes by email and will post the updated policy on this page with a revised effective date. We encourage you to review this policy periodically. Your continued use of the platform after any changes constitutes your acceptance of the updated policy.
